MAEDIX - Terms of Service

1. Agreement to Terms

By accessing and using MAEDIX ("Service," "Platform," "we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on MAEDIX's Platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Modifying or copying the materials
Using the materials for any commercial purpose or for any public display
Attempting to reverse engineer, decompile, or disassemble any software
Removing any copyright or other proprietary notations from the materials
Transferring the materials to another person or "mirroring" the materials on any other server
Using automated tools to scrape or collect data without authorization

3. Service Description

MAEDIX provides AI-powered automation for real estate agencies. Our Service includes:

Integration with Instagram business accounts
Automated responses to property inquiries in DMs and comments
AI-powered lead qualification
Lead scoring and routing to agents
Analytics and reporting dashboard

4. Account Responsibility

When you create an account with MAEDIX:

You are responsible for maintaining the confidentiality of your login credentials
You agree to accept responsibility for all activities that occur under your account
You must have authority to bind your real estate agency or business to these terms
You must provide accurate and complete information during registration
You agree to notify us immediately of any unauthorized use of your account

5. Instagram Integration & OAuth

By connecting your Instagram business account, you:

Grant MAEDIX permission to access your Instagram account via OAuth
Authorize MAEDIX to read and respond to DMs and comments on your behalf
Understand that MAEDIX responses are generated by AI and may require review
Agree to comply with Instagram's Terms of Service and API policies
Accept full responsibility for all AI-generated responses

Important: MAEDIX is a tool that assists with automation. You remain responsible for all communications sent from your account. We recommend reviewing AI responses before they are sent, where possible.

6. Acceptable Use Policy

You agree not to use MAEDIX for:

Sending spam or unsolicited messages
Misrepresenting property information or pricing
Violating fair housing laws or anti-discrimination regulations
Collecting personal data for purposes other than lead generation
Harassment, threats, or abusive communication
Illegal activities or fraud
Violating Instagram's Terms of Service

7. Payment Terms

Subscription fees are charged monthly or annually based on your selected plan
Payment is due in advance of each billing cycle
We accept major credit cards, bank transfers, and other payment methods
Failed payments may result in suspension of service
There are no refunds for partial months, but you may cancel at any time

8. Cancellation & Refunds

You may cancel your subscription at any time through your account settings
Cancellation takes effect at the end of your current billing cycle
No refunds are provided for unused portions of a billing cycle
Upon cancellation, your account data remains accessible for 30 days
After 30 days, all data will be permanently deleted unless you request restoration

9. Intellectual Property Rights

The MAEDIX Platform, including all code, design, logos, and content, is the exclusive property of MAEDIX. You may not reproduce, distribute, or transmit any content without our written permission. Your use of the Platform grants you a limited license to access the Service only.

Lead data and property information you provide to MAEDIX remains your intellectual property. You grant us a non-exclusive license to use this data to improve our AI models and provide the Service.

10. Disclaimer of Warranties

THE MAEDIX PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL LEADS GENERATED WILL RESULT IN SALES.

11. Limitation of Liability

To the fullest extent permitted by law, MAEDIX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity, even if advised of the possibility of such damages.

Our total liability to you for all claims arising from your use of the Platform shall not exceed the amount you paid to MAEDIX in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless MAEDIX from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these terms, or your violation of any applicable law or regulation, including fair housing laws.

13. Compliance with Laws

You agree to comply with all applicable laws and regulations, including:

Fair Housing Act and state fair housing laws
CAN-SPAM Act (if applicable to your communications)
GDPR and international data protection laws
Instagram Terms of Service and API policies
All local, state, and federal real estate regulations

14. Modification of Service

MAEDIX reserves the right to modify, suspend, or discontinue the Service at any time. We will provide notice of material changes via email. Your continued use of the Service after modifications constitutes acceptance of the changes.

15. Termination

We may terminate or suspend your account immediately, without prior notice, for:

Violation of these Terms of Service
Fraudulent activity or misuse of the Platform
Non-payment of fees
Use of the Service for illegal purposes

16. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of [Your Jurisdiction], and you irrevocably submit to the exclusive jurisdiction of the courts located in [Your Jurisdiction].

17. Severability
