Welcome to Maedix. These Terms of Service ("Terms") govern your use of our Instagram automation service for comment replies and direct messages. By using our services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Maedix, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Account Registration

• You must provide accurate and complete information during registration
• You must verify your email address through our OTP verification process
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to create an account
• One person may not maintain multiple accounts
• You are responsible for all activities that occur under your account

3. Service Description

Maedix provides Instagram automation services including:

• Automatic Comment Replies: Automatically reply to comments on your Instagram posts
• Automatic DMs: Send follow-up direct messages to users who comment on your posts
• Keyword Triggers: Configure specific keywords to trigger automations
• Multiple Message Variations: Set up multiple reply variations for natural-feeling interactions
• Post-Level & Account-Level Automation: Configure automations for specific posts or as defaults for your account

4. Instagram Account Requirements

• You must have an Instagram Business or Creator account to use our service
• You authorize us to perform actions on your Instagram account including replying to comments and sending DMs
• You are responsible for compliance with Instagram's Terms of Use and Community Guidelines
• We are not responsible for any actions taken by Instagram/Meta on your account

5. Acceptable Use

5.1 You Agree To:

• Use the service only for legitimate business or personal branding purposes
• Create genuine, helpful automated responses
• Comply with Instagram's rate limits and guidelines
• Monitor your automation activity regularly

5.2 You Agree NOT To:

• Use the service for spam, harassment, or misleading content
• Send automated messages that violate Instagram's policies
• Use the service to promote illegal products or services
• Impersonate others or misrepresent your identity
• Use automated messages for phishing or scams
• Exceed reasonable usage limits that may affect our service
• Attempt to circumvent any security measures

5.3 Content Guidelines

Your automated messages must NOT contain:

• Hate speech, threats, or harassment
• Sexually explicit content
• Misleading or deceptive claims
• Links to malware or phishing sites
• Content that infringes on others' intellectual property

6. Subscription and Payments

6.1 Subscription Plans

• We offer various subscription plans with different features and limits
• Plan details and pricing are available on our pricing page
• Free trials may be available for new users

6.2 Payment Processing

• Payments are processed securely through Razorpay
• You agree to provide accurate payment information
• Subscription fees are billed in advance on a monthly or yearly basis
• All prices are in Indian Rupees (INR) unless otherwise stated

6.3 Cancellation and Refunds

• You can cancel your subscription at any time from your dashboard
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial months or unused features
• We reserve the right to offer refunds at our discretion

7. Service Limitations

• Automation depends on Instagram's API availability
• We cannot guarantee 100% delivery of automated messages
• Instagram may rate-limit or restrict automation activities
• Service may be temporarily unavailable during maintenance
• We are not responsible for Instagram API changes or restrictions

8. Intellectual Property

The Maedix platform, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

9. Limitation of Liability

To the maximum extent permitted by law:

• Maedix is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• We are not responsible for actions taken by Instagram/Meta on your account
• We are not liable for any loss of followers, engagement, or revenue
• Our total liability shall not exceed the amount you paid us in the past 12 months

10. Indemnification

You agree to indemnify and hold harmless Maedix and its team from any claims, damages, or expenses arising from:

• Your use of our services
• Content of your automated messages
• Your violation of these Terms
• Your violation of Instagram's terms or policies
• Any claims by third parties related to your automated messages

11. Account Termination

• You may delete your account at any time from your settings
• We may suspend or terminate accounts that violate these Terms
• We may terminate accounts used for spam or abuse
• Upon termination, your automations will stop immediately
• Data deletion follows our Privacy Policy guidelines

12. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use of our services after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of India.
